THE NEW PNE AND THE FISCAL FRAMEWORK: CONSTITUTIONAL MINIMUM AND FINANCING GOAL FOR EDUCATION AT RISK

This article discusses the target for financing the next National Education Plan 2024-2034, proposed by CONAE-2024, in light of the current fiscal rules of the Brazilian State. Thus, this article will discuss the so-called new fiscal framework, established by Complementary Law 200/2023, and how it will affect the expansion of primary expenditure and, consequently, public expenditure on education. The conclusion we reached, both by carefully reading the fiscal rules and by the projections made by the National Treasury and by the executive itself, is that the fiscal framework imposed by the new fiscal framework will make the expansion of public financing for public education unfeasible in the next decade, investing in risk to the constitutional provision that establishes a floor for investment by the Union, states, federal districts and municipalities in public education. Therefore, in order to carry out the next PNE and maintain the constitutional minimum, we need to question the very fiscal rule that makes them unfeasible.
