Like any other laws, educational laws are historical sources and dated records that carry the memory of the actions and intentions of people at a given time. This text aims to analyze legislation as a historical movement to explain the characteristics of the society that produced it and its value as a source of educational memory. Based on historical-dialectical materialism, the study examines the law as a dynamic document revealing diverse data on social and educational realities. This allows us to characterize the society that produced the law. The text explores the concepts of history, memory, and sources, assuming that laws are dialectical syntheses of multiple determinations. It objectively demonstrates that educational legislation can be interpreted as historical memory by comparing the proposals in the 1961 and 1996 National Education Guidelines and Framework Laws, considering the theme of primary/elementary education. Thus, this study aims to contribute to the historiographical debate on memory, sources, and the use and interpretation of educational legislation in historical and educational studies.
