NEW REGULATORY FRAMEWORK FOR DISTANCE EDUCATION: IMPLICATIONS AND CHALLENGES FOR HIGHER EDUCATION

Abstract

This article analyzes the new regulatory framework for distance education (DE) in Brazil, examining its definitions, formats, transition rules, and quality benchmarks, while also discussing its implications for Higher Education Institutions (HEIs) and undergraduate course offerings. The study adopts a documentary approach, reviewing decrees and ordinances that regulate DE, highlighting the shift from a more permissive model to a stricter normative structure. The findings indicate that the new guidelines aim to strike a balance between innovation and academic quality, reinforcing the requirement for in-person and synchronous mediated activities in specific fields, such as health and law. However, this transformation presents challenges for institutions, which must adapt to new methodological and structural demands, directly impacting academic planning and student accessibility. The flexibility of adaptation deadlines allows for a more gradual transition, mitigating adverse effects for HEIs and students. It concludes that the more detailed regulation seeks to ensure the quality and safety of academic training, while also emphasizing the need for public policies that promote the democratization of higher education by providing inclusive and equitable access.

Chris Alves Da Silva, Catholic University of Brasília

She holds a degree in Elementary Education from the Catholic University of Brasília (2006), with specializations in Early Childhood Education (2008) and Distance Education (2009) from the same institution. She earned a Master’s degree in Education from the University of Brasília (2010) and is currently a doctoral candidate in Education at the Catholic University of Brasília (2025).She works as a faculty member at the Catholic University of Brasília, teaching undergraduate courses in Information Technology, Teaching Degrees, and general education subjects. She coordinates the Student Leadership Program (PPD) and is part of the team at the Center for Educational Innovation and Technology (NITE).She has supported academic management and taught in postgraduate courses (lato sensu) at the Catholic University of Brasília (UCB), in addition to teaching at UNICEPLAC and the University Center of the Federal District (UDF), where she also served as the area coordinator for the PIBID/Pedagogy program.Her area of expertise is Education, with an emphasis on Distance Education, Educational Technologies, and Early Childhood Education, mainly addressing the following topics: Early Childhood Education, Distance Education, Literacy, Science Teaching, Mathematics Teaching, Teacher Training, and Educational Technologies.

Valdivina Alves Ferreira, Catholic University of Brasília

She holds a Ph.D. in Education from the Pontifical Catholic University of Goiás (PUC GO) and a Master’s degree in Education from the Federal University of Mato Grosso do Sul (UFMS). She is a specialist in Educational Planning, Teaching Methods and Techniques, Computer Science, School Administration and Supervision, and holds a full licentiate degree in Pedagogy from FESURV. She has experience in coordination and teaching in higher education and postgraduate programs. She is a faculty member in the Graduate Program at the Catholic University of Brasília (UCB) and the leader of the Study and Research Group on Educational Public Policies in Basic Education (GEPPEB), registered with the National Council for Scientific and Technological Development (CNPq).Her areas of expertise include Educational Public Policies, Public Policies for Professional and Technological Education, Teacher Training, and Educational Informatics. She also serves as an Institutional and Course Evaluator for INEP/MEC.
