Abstract

This study analyzes the effectiveness of precautionary measures issued by the Inter-American Commission on Human Rights (IACHR) by measuring the time elapsed between the request for a precautionary measure submitted to the IACHR and the subsequent decision by the Inter-American Court of Human Rights (IACtHR) to grant or deny provisional measures. The objective is to assess the preventive nature of these measures in light of the impact of this time interval on the beneficiaries’ rights. This study adopts an empirical methodology based on the statistical and critical analysis of 41 IACtHR provisional measures resolutions issued between 2010 and 2025. The results reveal that this time lag exceeds one year in 50% of cases, implying a gradual deterioration of the protected human rights during the waiting period. In conclusion, the IACHR should adopt a swift and assertive stance during the interim phase, moving beyond procedural formalism and interpreting state inaction as an immediate justification for the IACtHR’s binding intervention.
