THE SCIENTIFIC NATURE OF THE JUDICIAL POLICE: THE INSTRUMENTALITY OF ETNOMETHODOLOGY FOR CONTEMPORARY OF CRIMINAL INVESTIGATION

The article examines the application of ethnomethodology in criminal investigation. This is a theoretical study, supported by a review of specialized literature, specifically scientific articles and academic books. It is based on a documentary research, by interpreting provisions of Law No. 14,735/2023. In this sense, it analyzes the relevance of criminal investigation being practiced as a qualitative research. That is to say, as for its goals, the present research can be understood as applied, in that it is aimed at solving practical and specific problems, namely, the cooling of penal protection in the face of criminal phenomena and the realization of human rights, including those of the second and third dimensions. The National Organic Law of the Civil Police addresses the civil police officer about the need for a closer relationship with scientific knowledge, especially that originating from the human and social sciences. This is not just a one-time increase in the training of civil police officers, but rather an effective appropriation of sociological knowledge that can be used in investigative diligences, so that the elements of information and evidence produced in police inquiries are accompanied by a refined understanding of the reasons why people get involved in criminal conflicts. This is a way for the civil police officer to fulfill the normative command by which they must participate in the formulation of public safety policies, contributing to the arrangement of more interesting and less intrusive solutions for criminal problems. This, it is suggested, can contribute to increasing the clarification of the authorship of criminal offenses.
